SeanetVoice User License Agreement
The SeanetVoice services are provided by Sea-Net Global LLC, a company incorporated under the laws of United State of America , with registered address 16192 Coastal Highway, Lewes, Delaware 19958 USA(“SeanetVoice”, “us”, “our” or “we”).
- If you do not agree to the terms and conditions of the Terms of Service, we will not license the App or other parts of the Services to you and you must stop using the App, the Site and the Services now.
- If you are residing in a jurisdiction where it is prohibited by law to offer or use internet telephony or other parts of the Services which we provide, you may not use the Services in such jurisdiction.
- NO EMERGENCY CALLS – The App and other parts of the Services are not intended to replace your ordinary or fixed line telephone services. As such, the App and other parts of the Services do not and are not intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit or any type of emergency services of any kind. Neither are they intended to support calls to operator or directory enquiry services. SeanetVoice is not liable in any manner for such calls. You must ensure that you, or anyone using your Device, have alternative arrangements for making any such calls.
In these Terms, capitalized terms have the following definitions:
1.1 SeanetVoice Credit: means the equivalent value in USD reflected on your SeanetVoice profile
1.2 SeanetVoice Websites: www.seanetvoice.com
1.3 Paid-For Products: any fee based SeanetVoice services
1.5 Products: Mobile Top-up services, Voice call minutes, Bundles, Virtual Number, SIP Trunking, generally any product as reflected on https://seanetvoice.com
1.6 Software: SeanetVoice’s internet communication software applications including any improvements, modifications, enhancements, fixes, updates, upgrades and future versions and whether made available for free or for a fee
1.7 Terms: the terms of this Use License Agreement
1.8 Third Party Services: any website, software and/or other technology owned and controlled by third parties which may be incorporated into or accessible through the Software, the Products or the SeanetVoice Website.
1.9 User Account: the account with user ID and password chosen by or assigned to you for the purpose of installing, accessing or using the Software and/or the Products.
1.10 User Submissions: any forms or emails or information submitted by the User
2. ACCEPTANCE OF TERMS OF SERVICE
You agree to be bound by the Terms of Service when you click accept in the sign-up flow. If you do not agree to the Terms of Service, you may not activate or use the Services. Once accepted the Terms of Service constitute a binding agreement between you and SeanetVoice In addition, by downloading the App from App Store or Google Play you agree to the applicable terms of the license of Apple and Google which will bind you.
SeanetVoice reserves the right to change, modify or discontinue, temporarily or permanently, the Website (or any portion thereof), including any and all content contained on the Website and Mobile App, at any time without notice. You agree that SeanetVoice shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Website.
SeanetVoice may make changes to Terms of Service from time to time. SeanetVoice will publish the changes at the Site. The changes will be effective when published. Please review the Terms of Service on a regular basis. You understand and agree that your express acceptance of the amended Terms of Service, or if you continue to use the Services after the date of publication, shall constitute your agreement to the updated Terms of Service. You agree that if you do not accept any amendment to the Terms of Service then you shall immediately stop accessing and/or using the Site, App or any other part of the Services.
3.1 Subject to your compliance with these Terms, you are granted a limited, personal, non-commercial, non-exclusive, non-sublicensable, non-transferable, non-assignable, free of charge license to download, install, access, and use the Software on a personal computer, mobile phone or other device; and personally use the Software through your individual SeanetVoice user account and for the sole purpose of using the Software. SeanetVoice reserves all rights not expressly granted to you under these Terms.
3.2 You may not and you agree not to: (a) sub-license, sell, assign, rent, lease, export, import, distribute or transfer or otherwise grant rights to any third party in the Software; (b) undertake, cause, permit or authorize the copying, modification, creation of derivative works or improvements, translation, reverse engineering, decompiling, disassembling, decryption, emulation, hacking, discovery or attempted discovery of the source code or protocols of the Software or any part or features thereof (except to the extent permitted by law);(c) remove, obscure or alter any copyright notices or other proprietary notices included in the Software;(d) use the Software or cause the Software (or any part of it) to be used within or to provide commercial products or services to third parties. The foregoing shall not preclude you from using the Software for your own business communications, subject to Section 2.1 above;(e) other than for the purposes of download and installation, use the Software except through your User Account.
Any copying or distribution, publication, or commercial usage of the Site, or any content, software, code, data, or materials on or from the Site, are strictly prohibited unless you have received express prior written permission from SeanetVoice.
3.3 The following shall apply to Third-Party Services:
3.3.1 any Third-Party Service that is incorporated in the Software, the Products, or the SeanetVoice Websites is subject to the provisions of these Terms;
3.3.2 use of Third Party Services may, in addition, be subject to your signing up for an account with and accepting the terms and conditions of the relevant third party, including provisions relating to the processing of personal data which may differ from SeanetVoice’s policies and for which SeanetVoice is not responsible. You acknowledge and agree that you are not entering into a contractual relationship with SeanetVoice or its related companies regarding such Third-Party Services and your rights and obligations are exercisable exclusively between you and the applicable third party;
3.3.3 SeanetVoice in its sole discretion, reserves the right to add or delete features or functions, and/or to provide programming fixes, updates, and upgrades to the Software, the Products, or the SeanetVoice Websites. You agree that SeanetVoice has no obligation to make available to you any particular version or element of the Software, the Products or the SeanetVoice Websites and that they are subject to change, termination or suspension for any reason at any time, at SeanetVoice’s discretion, including without limitation for maintenance, changes in applicable laws, SeanetVoice s business decisions, breach though your User Account of any provision of these Terms, or other policies or instructions given from time to time, or for any other reason within or outside SeanetVoice’s control. SeanetVoice will not accept any liability in relation to any loss or damage whatsoever caused by the release and/or the absence of release of new versions of the Software, the Products or the SeanetVoice Websites and/or the suspension or termination of the provision of or access to any part of the Software, the Products or the SeanetVoice Websites or these Terms. You also agree that you may have to enter into a modified version of these Terms, in order to download, install, access or use a new version of the Software, the Products or the SeanetVoice Websites.
4. THE SERVICES
SeanetVoice is currently offering cheap international calling and other VoIP mobile services including:
- Free Calls and Conference
- International calling services over an internet-based technology.
- Mobile Top-Up Service – transfer pre-paid airtime value
- Virtual Phone Numbers: referred to as US Phone Numbers.
SeanetVoice also offers SeanetVoice Calling, Audio conference and Video Call between and among the community of SeanetVoice App users
We can offer termination in several countries around the world, but we can’t guarantee that we support termination in all countries or to all phone numbers or that we always will support termination to any particular country or phone number. We make no representation that our Services are available for use in any particular location. The SeanetVoice service is not intended to be used for calls within one country.
Products/Services will be displayed on SeanetVoice’s official website www.seanetvoice.com and/or mobile apps on Google Play and Apple Store.
These communication services and all other services, products, features, functionalities and/or interactions as set forth in this document or presented on the Site or otherwise provided or made available to you by SeanetVoice from time-to-time, as well as the App and the Site shall collectively be referred to in these Terms of Service as the “Services”.
4.1. Intellectual property rights, licenses etc.
In consideration of you agreeing to abide by the terms and condition of the Terms of Service, we grant you a limited, non-transferable, non-sub licensable, non-exclusive, revocable license to use the App, the Site and other parts of the Services provided or made available to you by SeanetVoice. You may download a copy of the App onto a Device which you control and to view, use and display the App on the Devices for your personal purposes only. We reserve all other rights.
Not limiting the aforesaid, in relation to the App, we license the use of the App to you on the basis of the Terms of Service and subject to any rules or policies applied by Apple Inc. and/or Google Inc., or any other entity within the Apple or Google group (“Apple” and “Google”). We do not sell the App to you. We remain the owners of the App at all times.
You may not copy, modify, adapt, redistribute, decompile, reverse engineer, disassemble, or create derivative works of the Software, the App, Site or, to the extent applicable, any other part of the Services (or permit or assist any third party in such activities). You must not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) that may be affixed to or contained within the Software.
The Software may contain open source software. Any use, reproduction and distribution of components of the Software licensed under an open source software license is governed by the terms of such open source software license, however to the extent permissible thereunder and otherwise if applicable, the Terms of Service shall apply with priority over such open source software license.
You acknowledge that you have no right to have access to the App or other parts of the Services (where applicable) in source-code form.
All ownership and intellectual property rights in or to the Software, the App, the Site or, to the extent applicable, other parts of the Services and any copies and derivative works thereof (regardless of form or media in or on which the original or other copies may exist), including but not limited to patents, design rights, copyrights, trademarks, trade-secrets and proprietary know-how, shall be owned by and vested in SeanetVoice, or SeanetVoice’s licensors, and nothing in these Terms of Service shall constitute or be interpreted as a transfer of any such rights from SeanetVoice to you or anyone else. You are, as stated above, solely entitled to the limited license to the Services specifically granted under this the Terms of Service. For the purpose of clarification; nothing in these Terms of Service give you a right to use any of SeanetVoice’s trade names, trademarks, service marks, logos, domain names, or other distinctive brand features, except as may be contained in or otherwise used within the Services provided to you.
4.2.Use of the Services
You agree to use the Services only in such way that is permitted by the Terms of Service and to act in compliance with any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including without limitation any applicable export laws and regulations).
It is your responsibility to ensure that you are legally allowed to use the Services where you are located. If any laws applicable to you restrict or prohibit you from using the Services, you must comply with those legal restrictions or, if applicable, stop accessing and/or using the Services.
Neither the Products nor the Software are intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit or any other kind of services that connect a user to emergency services personnel or public safety answering points (‘Emergency Services’).
You acknowledge and understand that the voice communication service provided by SeanetVoice is not a traditional telephone service or a replacement for your primary telephone service. Important distinctions (some, but not necessarily all, of which are described in this Agreement) exist between the traditional telephone service and the voice communication services provided by SeanetVoice.
You acknowledge that the products, features or functions or other parts of the Services may change over time. SeanetVoice may without prior notice to you change the form and nature of the Services. This could mean, among other things, that future versions of the Software or the App may be incompatible with applications developed on or with previous versions. Furthermore, SeanetVoice may. in SeanetVoice’s sole discretion and without prior notice to you, stop (permanently or temporarily) providing the Services to you or to users generally. SeanetVoice may make updates of the Software, the App or other parts of the Services at any time, but shall have no obligation what so ever to provide any such updates to you. It is your responsibility to use the latest available version of the Software, App or other parts of the Services (where applicable).
4.3. Jurisdictional Restrictions
You must use the Software, Products and SeanetVoice Websites in accordance with the laws of where you are located. In some countries there are restrictions on the download and use of the Software, Products and/or SeanetVoice Websites. It is your responsibility to ensure that you are legally allowed to use the Software, Products and/or SeanetVoice Websites where you are located.
4.4. Your Account
In order to use the Product, the Site, and the Service, you are required to register a user account with SeanetVoice. You agree to provide true, accurate, up-to-date and complete information in all fields indicated as mandatory when registering, as well as any additional information provided or any amendments made by you.
You are fully responsible towards SeanetVoice for all (including any fraudulent) use of the Services which is or can be connected to your Account.
4.5. Virtual Number provided by SeanetVoice
Virtual numbers are offered on pre paid basis and when a customer fails to pay for the next billing interval the telephone number will be canceled. SeanetVoice does not warrant and represent that the telephone numbers will be reachable from all mobile and fixed networks. The Virutal numbers provided by SeanetVoice does not warrant to support messaging via SMS.
You acknowledge and agree that under special circumstances SeanetVoice may cancel, substitute or change virtual phone numbers allocated to you in its sole discretion. You acknowledge that SeanetVoice shall not be liable for any damages (including consequential or special damages) arising out of telephone number allocations. Upon termination of your SeanetVoice account for any reason, or termination of telephone number subscription, you will no longer have access to telephone numbers allocated to you; consequently these telephone numbers will be reassigned to other customers and once reassigned SeanetVoice will not be able to assign the same telephone number to you in the future. Telephone numbers are offered on pre paid basis and when a customer fails to pay for the next billing interval the telephone number will be canceled. SeanetVoice tries its best to ensure interoperability of the purchased virtual numbers in order to make the telephone numbers reachable from as many mobile and fixed networks as possible. However, as SeanetVoice relies on the interoperability of services from its local partner(s) in each country for end-to-end connectivity, SeanetVoice does not warrant and represent that the telephone numbers will be reachable from all mobile and fixed networks. SeanetVoice service and SeanetVoice US phone numbers must not be used to trigger callback services and collect calls. The minimum service term for a phone number is 1 month as from the order date. A Virtual Number canceled by mistake will not be refunded
4.6. Call Recording
SeanetVoice offers a feature that allows you to record various phone conversations. The laws regarding the notice and notification requirements and use of such recorded conversations vary from country to country and state to state. You acknowledge and agree to be solely responsible for complying with all international, federal, state and local laws in the relevant jurisdiction when using this feature. SeanetVoice expressly disclaims any and all liability related to your recording of phone conversations. You agree to release and to hold harmless SeanetVoice from and against any damages or liabilities of any kind related to the recording of any phone conversation using the Service.
4.7. Mobile Top-UP Service
4.7.1 We are responsible for collecting all payments for orders you have placed on this website. Payment is authorized at the time the order is placed by you, and the payment will be taken from the bank account registered in your account. The rates for mobile recharges are subject to change without any prior notice.
4.7.2 SeanetVoice is not responsible and will not offer any refunds for any loss you may incur in case of mistyping the recipient’s phone number, choosing the incorrect operator or entering incorrect information.
4.7.3 It may take up to 24 hours for the mobile operator to update the credit to the prepaid number you selected.
4.7.4 Some operators may apply VAT and taxes that will be deducted from the mobile recharge amount based on the local rules of destination network.
4,7.5 Once the recharge is accepted by the operator whose contact information is available on the invoice, the operator becomes responsible for completing the recharge.
4.7.6. Mobile Top-up Service Agreement —Subject to change at any time in the sole discretion of service provider.
4.8. Unauthorized use, stolen device
You are solely responsible for all activities that occur on or otherwise is associated with you Account, regardless of whether the activities are undertaken by You or a third party and whether or not authorized. SeanetVoice is not responsible for any unauthorized access to the Account. You are required to contact SeanetVoice immediately to suspend the Services and block your Account if you suspect that your mobile phone or other device you are using the Product, the Site, and the Service on (“Device”) is stolen or otherwise that an unauthorized third party may be using the Account or if your password/PIN or any other account information is lost or stolen. You are responsible for all charges to your Account until the Services are suspended and the Account is blocked.
We have the right to change your password at any time in our sole discretion and without notice, should we become aware of or suspect an unauthorized use.
4.9. Prohibited use and restrictions
You warrant to use the Services only in such way that is permitted by the Terms of Service and to act in compliance with any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. If any laws applicable to you restrict or prohibit you from using the Services, you must comply with those legal restrictions or, if applicable, stop accessing and/or using the Services.
You agree to be solely responsible for the contents of your transmissions through the Services. You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another’s privacy, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, contains viruses, or that infringes or may infringe the intellectual property or other rights of another. SeanetVoice acts as a passive conduit for you to send and receive communications and information of your choice and SeanetVoice has no control over the content of any transmission nor will it be liable for such content. You agree not to use the Services for the transmission of unsolicited messages, spamming emails.
You agree that you shall not, at any time, use the Service for any abusive purpose or in any way which interferes with our ability to provide Service to other customers or restricts other customers from using the Service, or damages any SeanetVoice or other customer’s property. You acknowledge and agree that, by using the Service, you may be exposed to content others send you that is objectionable, offensive, or indecent. You understand and agree that SeanetVoice has no control over the content of any audio, video or text transmissions relayed to you through the Service and you agree to hold SeanetVoice harmless for any harm suffered due to the content relayed to you through this Service. SeanetVoice reserves the right to restrict phone calls to any telephone number in its sole discretion. You will abide by all applicable local, state, national and international laws and regulations of countries of all phone call participants connected using the Service.
You shall not violate any US or foreign export control laws.
You shall not attempt to hack or otherwise disrupt the Service or make any use of the Service that is inconsistent with its intended purpose.
You shall not attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service by any means.
Collect information about other people without their consent.
Create a false identity or to otherwise attempt to mislead any person as to the identity or origin of any communication.
Misrepresent or otherwise attempt to mislead any person as to your information or otherwise engage in fraudulent or deceptive conduct Transmit any material that may infringe the intellectual property rights or other rights of third parties, including without limitation, trademarks, trade secrets or copyrights;
SeanetVoice may delete any Content that in the sole assessment of SeanetVoice violates this Agreement or that may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. SeanetVoice assumes no responsibility for monitoring the SeanetVoice Services for inappropriate Content or conduct.
Unusual calling patterns inconsistent with normal, individual subscription use may also be considered unauthorized use. SeanetVoice reserves the right to take any unlawful, prohibited, abnormal or unusual activity into account in making its determination. Excessive conferencing or call forwarding, excessive numbers of regular calls of short duration, calls to multiple numbers in a short period of time, auto-dialing or fax/voice blasts, use without live dialogue and/or consistent excessive usage will be considered indicators of such unauthorized or excessive use.
Use of Predictive Dialers, Auto Dialers, Telemarketing Devices, Lead Generators and other similar programs is prohibited. In accordance with the Digital Millennium Copyright Act in appropriate situation SeanetVoice will terminate your Service if you violate the copyrights of third-parties. SeanetVoice may or may not attempt to contact you, in its sole discretion, prior to such service suspension or termination.
4.10 Submission of information to SeanetVoice
You agree that any comments, suggestions, feedback, documents, content or other material or information provided, shared, published by you in connection with the use of the Services or otherwise in your contacts with SeanetVoice (including but not limited to, the use of blogs, forums and support websites) is provided on a non-proprietary, non-exclusive and non-confidential basis. You grant SeanetVoice a royalty-free, world-wide, transferable, sub-licensable, perpetual and irrevocable license to use any such material or information. You acknowledge that you are responsible for whatever material or information is provided by you, including its legality, reliability, appropriateness, originality and copyright.
4.11 Disclosure of information
SeanetVoice reserves the right at all times to disclose any data or information (in any form) as SeanetVoice deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove or restrict any information or materials, in whole or in part, in SeanetVoice’s sole discretion.
4.12 No warranties
You expressly acknowledge and agree that use of the Services are at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, with all faults and without warranty of any kind, and we hereby disclaim all warranties and conditions with respect to the Services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. We do not warrant against interference with your enjoyment of the Services or that the Services will be uninterrupted or error-free, or that defects in the Services will be corrected. No oral or written information or advice given by us shall create a warranty. Should the service cause any defects, you assume the entire cost of all necessary servicing, repair or correction. Additionally, you also understand that SeanetVoice cannot guarantee that information or communications transmitted in relation to the use of Services will not be subject to interception by law enforcement officials or other third parties.
4.13 Suspension and interruption of the Services
SeanetVoice has the right, without any liability, to refuse to provide, restrict, limit, change, remove, disable, suspend and/or interfere or interrupt the Services or any part thereof, at any time and without any prior notice to you, for the repair, improvement, and/or upgrade of the Service, or for any of the reasons for termination set forth in the Terms of Service, or any corporate or business reason.
4.14 Content of Communication
The content of the communications made using the Services are entirely determined by the person from whom such content originates. You may therefore be exposed to content that is offensive, harmful, indecent or otherwise objectionable. SeanetVoice will not be liable for any type of communication spread by means of the Services.
5.1 The rates for the Services are published on website (www.seanetvoice.com) and inside the SeanetVoip App. SeanetVoice reserves the right to change the rates (offers, deals, plans or similar) at any time without notice. The new rates will apply to your next phone call or otherwise the next time you use the Services after the publication of the new rates. If you do not wish to accept such adjustment of rates, do not use the Services. No refunds are available. You agree that by continuing to use the Services, following the adjustments of the rates, you accept such adjustments.
5.2 You can use the mobile top-up service provided by SeanetVoice; In this case you will be required to input a receiver mobile phone number. It is your responsibility to ensure that you have correctly inputted the information. You acknowledge that you will lose the right to cancel the services once they have been fully performed by SeanetVoice. Accordingly, you will have no right to request a refund under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013
Unless stated otherwise, all rates and charges for the Services shall be stated in US dollars (USD) and shall be inclusive of value added taxes (VAT).
5.3 Using the Software on mobile applications may require you to contract, set up and pay for data and/or communications services from your internet service or your mobile network operator. Out-of-country usage may lead to significantly higher costs than regular usage, and you are solely responsible for keeping yourself informed and paying for possible roaming and other applicable charges levied by your mobile network operator.
6. PAYMENT, DELIVERY, RATES AND ACCOUNTS
If you wish to use Paid For Products, you must agree to all the terms of this Section. All the other provisions of this Terms also apply to Paid For Products.
Service is offered on pre-paid bases. You agree to maintain positive account balance all the time in order to receive the Service(s). Accounts with negative balances may be suspended, terminated or be limited in service; specifically phone numbers assigned by SeanetVoice will not accept incoming calls. Effective Account Balance should be positive in order to place any call using the Service. When Effective Balance is negative the service will be limited including without limitation calls to new participants. You hereby release and agree to hold harmless SeanetVoice from and against any damages or liabilities of any kind related to such limitation of service when Effective Balance or Account Balance is negative.
All payments are processed via a third party payment processor (“Payment Processor”). You agree to provide complete and accurate payment information and further agree that the processing of payment transactions is subject to the terms, conditions and policies, including privacy policies, of the Payment Processor and your credit or debit card issuer.
SeanetVoice Credit Card payments will appear as Sea-Net Global LLC on your bank or card statement.
If the law of your country or location prohibits you from using the Paid For Products whether due to age restrictions, content laws or other legal restrictions, you must not use the Paid For Products and any payments that you make will not be refunded
6.3 Monthly Subscription
By purchasing a monthly subscription, you agree to an initial and recurring monthly subscription feeat the-then Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your Monthly Subscription at any time subject to the terms of our “cancellation Policy”.
6.3 Monthly Subscription
By purchasing a monthly subscription, you agree to an initial and recurring monthly subscription feeat the-then Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your Monthly Subscription at any time subject to the terms of our “cancellation Policy”.
6.4 Automatic Monthly Renewal
Once you subscribe, SeanetVoice will automatically process your Monthly Subscription fee in the next billing cycle. SeanetVoice will continue to automatically process your Monthly Subscription fee each month at the then-current monthly subscription rate until you cancel your subscription. If your account balance is negative at the renewal date then subscription will be canceled.
6.5 Charge Backs
You acknowledge and agree that payments/deposits are final once completed. We strongly discourage the use of charge backs or payment reversal. If you believe that your account was charged fraudulently or erroneously you must follow our dispute procedure 1) contact our billing department via online ticketing system. You must provide the following information a) your name b) your contact information c) last four digits of the credit card number in question d) name on the credit card and the date when the credit card transaction occurred and the total amount charged to the credit card. You will be contacted by SeanetVoice customer support representatives to try to resolve the matter. 2) If you did not reach an agreement with our customer support representative, you must then contact our legal department via email at firstname.lastname@example.org to try to resolve the matter. If you take actions to reverse your Account charges with your credit card company or payment processor for any reason without first following the dispute procedure set forth herein, we reserve the right to terminate your account and pursue you legally through an attorney and or/collection agency and any other means for damages, including, among other things, fraud.
6.6 Refunds and Bonuses
There is no refund for any prepaid services. However, if you believe that SeanetVoice has charged you in error, you may request for a refund by submitting a written request in English to SeanetVoice’s Customer Support at email@example.com
No refunds shall be given for services paid or credit acquired through vouchers, gift tokens or similar.
SeanetVoice reserves the right to change the refund policy without any prior notice.
We make our best efforts to reward SeanetVoice’s loyal customers by means of bonus campaigns, including the referral (intended to promote SeanetVoice products to new users), ad videos, and testing programs. However, there may be rare situations where a program does not work properly due to some technical restrictions. Please refer to FAQ or contact technical support if you believe you experience some issues.
As a loyal user of the Service, you may be suggested to get a refund to your SeanetVoice account as some percent of the amount that you spend on calls to your favorite phone number. You will be prompted to select this number. You won’t be able to change it later yourself. The favorite number can only be changed through SeanetVoice support and only once a month.
All free credits received by users during a bonus campaign are for the personal use in the SeanetVoice applications and services only. These credits are non-refundable, non-transferable and can’t be converted into money. In order to prevent fraudulent usage, misuse, and taking advantage of the referral system, SeanetVoice may limit the maximum amount of free credits to be received by users and withdraw issued bonuses. Creating multiple accounts with different phone numbers by one user is also considered as a misuse. SeanetVoice may withdraw free credits that have not been used by users within a period of 30 days after issuance date.
Bonus campaigns are valid until further notice. SeanetVoice reserves the right to stop a campaign at any time and for any reason, at SeanetVoice’s sole discretion.
6.7 Account and receipt
When you log in to your Account you will find certain information relating to your use of the Services, such as payments made, calling history (during a limited period) and your current balance etc., It is your responsibility to print and/or save copies of your records (invoices, receipt, etc.)
6.8 Expiration of credits
A credit balance on the Account will expire 12 months after the last activity of the Services, meaning that any credit balances that are not used within the aforesaid 12 months period will be lost.
6.9 Cancellation Policy
You may cancel your monthly subscription at any time by logging into your SeanetVoice account via the mobile app. Click on “Buy Credit” and view your currently active subscriptions. You can cancel your subscription by clicking on the“Cancel Subscription” button. If you are unable to cancel your subscription via the SeanetVoice app for any reason, please email us on firstname.lastname@example.org and we will confirm your cancellation request.
If you cancel your Monthly Subscription, the cancellation will take effect from your next monthly billing cycle which is 1 calendar month starting from your payment date. Once the cancellation is confirmed, you will not be able to use the service and you will not be eligible for a refund for the monthly subscription fee paid prior to the month the cancellation takes effect.
7. TERMINATION AND SUSPENSION
The Terms of Service is effective until terminated by you or SeanetVoice. You may terminate the Terms of Service (cancel the Account, the Services or SeanetVoice Websites.) by sending SeanetVoice a termination notice to email@example.com(the Account will be cancelled within five (5) days of receipt of such notice).
7.1 SeanetVoice may terminate its relationship with you, or may terminate or suspend your use of the Software, User Account(s), Products or SeanetVoice Website at any time and without recourse to the courts:
(a) if you are in breach of these Terms;
(b) if SeanetVoice reasonably suspects that you are using the Software, the Products and/or SeanetVoice Website to break the law or infringe third party rights
(c) if SeanetVoice reasonably suspects that you are trying to unfairly exploit or misuse the refund policy, or any of our policies
(d) if SeanetVoice reasonably suspects that you are using our Products, Software and/or SeanetVoice Website fraudulently or that your User Account is being used by a third party fraudulently
(e) if you have purchased SeanetVoice Credit from an unauthorized reseller
(f) in respect of a particular Product, on thirty (30) days’ notice if SeanetVoice decides to cease offering that Product
(g) immediately, if required due to a change in laws/regulation by a regulator or authority with a lawful mandate, or by any of SeanetVoice’s partners
(h) on thirty (30) days’ notice if SeanetVoice decides to cease offering the Software to users in your jurisdiction generally.
7.2 SeanetVoice shall effect such termination by preventing your access to your User Account, the Software, Products and/or SeanetVoice Website (as applicable). We reserve the right to cancel User Accounts that have been inactive for more than one (1) year.
7.3 Consequences of Termination: Upon termination of your relationship with SeanetVoice:
(a) all licenses and rights to use the Software, Products and/or SeanetVoice Website shall immediately terminate
(b) you will immediately cease any and all use of the Software, Products and/or SeanetVoice Website
(c) you will immediately remove the Software from all hard drives, networks and other storage media and destroy all copies of the Software in your possession or under your control.
7.4 SeanetVoice will not be liable for any direct or indirect loss or damage caused by the termination of these Terms whether or not SeanetVoice has been advised of the possibility of such loss.
SeanetVoice reserves the right to suspend or discontinue the Service generally, or to terminate your Service, at any time in our sole and absolute discretion.
If we discontinue the Service generally you will only be responsible for charges accrued through the date of termination, including a pro-rated portion of the final month’s charges and the balance of pre-paid amounts.
If your Service is terminated due to your breach of any provision of this Agreement, you will be responsible for the full month’s charges to the end of the current term, including, without limitation, un-billed charges, plus the termination fee, if applicable, all of which will immediately become due and payable.
If SeanetVoice or you terminate your right to use the Service, you shall not be entitled to any refund or pro ration of any pre-paid amounts.
Upon any termination in accordance with the foregoing, SeanetVoice will delete related information and files in your Account, reassign any telephone numbers associated with the account, and/or prevent any further access to such files, information, or the Services.
SeanetVoice may assign all or part of the rights and/or obligations under the Terms of Service without notice to you. SeanetVoice may assign all or part of the rights and/or obligations under the Terms of Service without notice to you. You may not assign any rights or obligations under the Terms of Service to any third party without the prior written consent of SeanetVoice.
8.2 Limitation of Liability
In no event shall SeanetVoice and its subsidiaries, affiliates, officers, directors, employees, and agents and any other service provider who furnishes services to you in connection with the Services, be liable for any consequential, indirect, special, punitive or incidental damages, or damages for loss of money, data, goodwill, reputation, business information or business profits, business interruption, or other pecuniary loss, that result from the use of or inability to use the Services or otherwise arise under the Terms of Service, even if it has been advised of the possibility of such damages.
In any event, and without limiting the generality of this Section to the extent permitted by law, you agree that SeanetVoice’s total aggregate liability to you for all damages and losses that arise in connection with the use of or inability to use the Services, or otherwise arise under the Terms of Service, shall not in any circumstance exceed the amount actually paid by you, if any, to us for the Services (including without limitation the Mobile Top Up Services) in the five (5) month period immediately prior to the date of the event giving rise to the relevant claim, subject to a maximum of One thousand (1 000) US dollar in all cases.
You agree to indemnify, defend and hold harmless SeanetVoice and its subsidiaries, affiliates, officers, directors, employees, and agents and any other service provider who furnishes services to you in connection with the Services, from any claim or demand or governmental investigation or enforcement action (including without limitation reasonable attorneys’ fees) made by any third party due to or arising out of Your use of the Services (including without limitation posting and submitting of any material), your breach of the Terms of Service, or Your violation of any rights of another person or entity.
Headings used in the Terms of Service are for convenience purposes only and shall not be deemed to limit or affect any of the provisions hereof.
8.5 Ability to Contract.
You hereby affirm that you are fully able and competent to enter into the Terms and Conditions, and to abide by and comply with the Terms and Conditions.
8.6 Force Majeure
You acknowledge and agree that if SeanetVoice is unable to provide the Services as a result of a force majeure event, SeanetVoice will not be in breach of any of its obligations towards you under the Terms of Service or otherwise. A force majeure event means any event beyond the control of SeanetVoice.
